Terms and Conditions

Welcome to
Acclaim Networking. These Terms and Conditions (“Terms”) govern the relationship between Acclaim Networking (“Company,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”) regarding the provision of IT services, network optimization, and consulting. By engaging our services or using our website, you agree to comply with and be bound by the following terms.
1. Scope of Services
Acclaim Networking provides a range of professional IT services, including but not limited to:
- Local Area Network (LAN) design and optimization.
- Managed IT services and proactive monitoring.
- VPN and remote access configuration (e.g., SonicWall Global VPN).
- Hardware upgrades, Windows 11 migrations, and data transfers.
- Internet of Things (IoT) integration.
Specific deliverables, timelines, and fees will be outlined in a separate Service Agreement or Statement of Work (SOW).
2. Client Responsibilities
To provide high-performance solutions, we require your cooperation. Client responsibilities include:
- Access: Providing physical and administrative access to servers, routers, switches, and workstations as needed.
- Information: Providing accurate technical requirements and disclosing known issues with existing infrastructure.
- Backups: Unless specifically contracted for Disaster Recovery Services, the Client is responsible for maintaining current backups of all data prior to any hardware or software service.
3. Payments and Fees
- Invoicing: Invoices are issued according to the schedule defined in your Service Agreement.
- Payment Terms: Payments are due within [30] days of the invoice date unless otherwise specified.
- Late Payments: Late payments may be subject to a fee of [1.5%] per month on the outstanding balance.
4. Hardware and Third-Party Software
- Warranties: Acclaim Networking does not provide direct warranties on hardware (e.g., routers, switches, PCs). All hardware is covered by the manufacturer's warranty.
- Licensing: The Client is responsible for ensuring all software (including Windows OS and specialized business applications) is properly licensed.
5. Limitation of Liability
While we strive for zero-bottleneck productivity, IT environments are inherently complex.
- Acclaim Networking shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruption, arising from network downtime or hardware failure.
- Our total liability for any claim shall not exceed the amount paid by the Client for the specific service in question during the three (3) months preceding the claim.ronments are inherently complex.
6. Confidentiality and Security
We take your data security seriously.
- Confidentiality: We agree to keep all Client business information, network configurations, and proprietary data confidential.
- Security Risks: While we implement high-level security (firewall upgrades, VPN encryption, IoT segmentation), no system is 100% impenetrable. We do not guarantee that your system will be immune to all cyber threats but promise to use industry-standard best practices to mitigate risks.
7. Termination
Either party may terminate a service agreement with [30] days' written notice. Upon termination, the Client is responsible for payment for all services rendered up to the termination date.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Salt Lake City, Sandy, Murray, Midvale, without regard to its conflict of law provisions.
9. Changes to Terms
Acclaim Networking reserves the right to modify these Terms at any time. Updated terms will be posted on our website with a revised "Effective Date."
